Resolution on On-Street Parking

The Board has received numerous complaints and concerns regarding safety issues related to on-street parking, i.e. emergency vehicles may not be able to gain access due to vehicles parked on the street; danger to children as children may dart from behind or in front of a parked vehicle into the path of oncoming traffic. The Charleston Village Covenants prohibit on-street parking. The Board has passed a resolution that authorizes a $50.00 per day fine for each day the violation continues after the date the notification letter is sent from the Board to the owner.

CHARLESTON VILLAGE HOMEOWNERS ASSOCIATION

R E S O L U T I O N

As the covenants for Charleston Village Homeowners Association prohibit on-street parking, the Board of Directors has always responded to complaints regarding on-street parking and will continue to do so in the future.

Effective January 1, 1999, a Planned Unit Development Act permits a Homeowner Association to impose a fine for a covenant violation. Parking on the street within Charleston Village is a covenant violation. The Board has voted to impose a $50.00 per day fine for each day the violation continues after the owner has been notified. The Board has elected to give the owner a defined period of time to move the vehicle before imposing the fine. The defined period will be two weeks from the date of the notification.

Therefore, the Board has resolved to enforce this Covenant and notify the owners via an article published in the Charleston Village Homeowners Association newsletter.

This resolution is adopted and made a part of the February 4, 2002 BOD Meeting Minutes.
